What are a tenant’s main rights and obligations?

Categoria: Tenancies

A tenant obtains a right to use property in return for periodic rent under a tenancy agreement. Rights and obligations are principally governed by Articles 1571 onwards of the Italian Civil Code and, for residential premises, Law 431/1998.

Tenants are entitled to full, peaceful enjoyment for the contractual term. Landlords must deliver premises in good repair, fit for the agreed use, guarantee quiet enjoyment and undertake the repairs for which they are responsible.

Tenants also have a right to privacy. Owners cannot freely enter rented premises: visits must be agreed, except in emergencies.

Tenants must pay rent and agreed additional charges, such as certain communal expenses, punctually. Non-payment may be a serious breach entitling the owner to commence eviction proceedings for arrears.

Under Article 1587, tenants must exercise ordinary reasonable care, avoiding misuse or conduct causing damage. At the end of the tenancy they must return the property in its original condition, allowing for normal wear.

Tenants cannot alter the property freely. Work changing its structure or use generally requires the owner’s consent and sometimes building authorisations.

A tenancy balances reciprocal rights and duties: safe, peaceful occupation on one side, and compliance with the law and agreement on the other. Understanding these principles supports a sound landlord-tenant relationship and helps prevent disputes.
