To mortgage loan is a contract under which a bank or other lender provides a sum of money that the borrower must repay over time on agreed dates and terms, usually through periodic instalments comprising principal and interest.
The Italian Civil Code defines a loan as a contract whereby one party delivers money or other fungible goods and the other undertakes to return an equivalent quantity of the same type and quality. In real estate practice, however, “mutuo” almost always means bank financing for buying, building or renovating a property.
It is one of the most widely used means of buying a first home. Property prices are often too high for purchasers to pay entirely from available funds. The bank advances a substantial part of the purchase price and the borrower repays it gradually, generally over ten to thirty years.
Approval is not automatic. Before lending, banks assess the applicant’s ability to make repayments, considering income, employment, existing borrowing and the relationship between the requested amount and the property’s value.
The bank normally requires a mortgage charge over the property as security. This gives it a right to recover from the asset if the borrower seriously and persistently defaults. The bank does not become the owner, but may use the legal enforcement procedures to recover its debt if the loan is not repaid.
The interest rate is a major consideration. Fixed-rate loans retain the same rate throughout; variable rates change with market reference indices. Intermediate arrangements, such as mixed rates or capped variable rates, aim to balance stability and flexibility.
The loan is concluded by notarial deed. The notary checks the transaction, the parties’ identities and the property documents, and receives both the loan agreement and the mortgage instrument, providing legal validity and certainty.
A mortgage loan provides the funds needed to buy or improve property without immediately paying the full investment cost. Instalment repayment, supported by mortgage security, facilitates access to property ownership and is an important institution in modern economic and legal practice.
